CRIMINAL LAW II

Question One:

(a) Derek is a distinguished legal Scholar based at Flint University. On 30^th November, 2017 while walking home from a lecture, he received a call from his childhood friend Kimeno who had been detained at Industrial Area Prisons for allegedly committing murder. While visiting his friend Kimeno in Prison, he was introduced to Sodoma and Gomora who had been arrested and detained for allegedly committing Robbery with Violence and Rape.

The Commissioner of Prisons upon learning of Derek’s scholarly exploits requested him to write a comprehensive analysis of the ingredients (mens rea & actus reus), possible defences and sentence/punishment available to persons charged with Murder, Rape and Robbery with Violence. (25 Marks)
